Form MO026 is the Services Australia request for a notice of past benefits under the Medicare Compensation Recovery program. In a compensation claim for an injury or illness, the notice sets out the Medicare benefits and certain care subsidies already paid in relation to that injury, which the parties use to work out what must be repaid to the Commonwealth when the claim resolves.

What is Form MO026 used for
MO026 is the first step in requesting a notice of past benefits under section 21 of the Health and Other Services (Compensation) Act 1995. After the form is submitted, Services Australia issues a Medicare history statement and declaration to the injured person or claimant to complete, and only then can the notice of past benefits be issued. The notice expires 6 months from its date of issue, so a fresh process is needed if the claim has not resolved by then.
The form is not always required. If the injured person is not listed on a Medicare card and has received no aged care benefits or subsidies in relation to the claim, there is nothing to notify. It is also not used where a reimbursement arrangement exists, which has its own form (MO027), or where the claim falls under a Bulk Payment Agreement.
Who uses Form MO026
The form can be completed by the injured person, the claimant (such as a legal representative making the claim on their behalf), an authorised third party such as a law firm, or the compensation payer. Where someone other than the injured person completes it, the form asks about the relationship and requires supporting documentation.
For an injured person younger than 14, the claimant must be a parent or guardian, with evidence such as a birth certificate or guardianship order if they are not on the same Medicare card. For a person 14 or older who lacks capacity, or who is deceased, documents such as a power of attorney, court order, will, or probate are required.
How to fill out Form MO026
Gather the claim reference details and the injured person's Medicare information first:
- Enter the compensation case or claim reference numbers held by Medicare and the insurer, if known.
- Identify the injured person, including their Medicare card number, name, date of birth, and contact details.
- Record the date of the injury or illness and a brief description. If the exact date is unknown, the form says to use the first of the month and year or the date of first treatment.
- Select the compensation type, such as workers' compensation, motor vehicle accident, common law, or public liability, and list any other claims for the same injury.
- Complete the claimant or authorised third party sections, with the supporting documentation the form requires, if you are acting for the injured person.
- Sign and date the declaration. Incomplete forms are not processed, and each case needs its own form.
How to submit Form MO026
Return the completed form and supporting documents by email to the Medicare Compensation Recovery address printed on the form, or by post to the program's postal address. Send a separate form for each case, and check every required question, since incomplete forms are not processed and edits to previously submitted forms are not accepted.
