What is Form MO022 used for

Under section 23 of the Health and Other Services (Compensation) Act 1995, a notice of judgment or settlement must be sent to Services Australia within 28 days of the judgment or settlement date, where the amount fixed is above the threshold set out in the form. The notice gives Services Australia what it needs to determine the amount repayable to the Commonwealth before the compensation is finalised.

The form also covers the advance payment option under section 33B of the Act, which lets the notifiable person pay a fixed proportion of the compensation to Services Australia and release the balance, subject to the conditions the Act sets. Any advance payment is later reconciled, with excess amounts refunded and shortfalls recovered.

Who uses Form MO022

The form is completed by the notifiable person, which the form defines as the compensation payer, typically an insurer or the party liable to pay the compensation. Failure or refusal to give notice can leave the notifiable person liable for any outstanding amount owing to the Commonwealth, so insurers and their solicitors treat this as a standard step in finalising a claim.

In some cases a Section 23A statement (form MO023) must be lodged with MO022, for example where no notice of past benefits was ever issued for the case, or where the last notice had expired at the time of judgment or settlement. Obligations and timeframes come from the legislation, so parties usually take legal advice on their specific duties.

How to fill out Form MO022

Have the settlement documents and the injured person's Medicare details available:

• Confirm first that the judgment or settlement amount is above the threshold stated on the form; below it, the form says you do not need to notify the case.
• Enter the compensation case or claim reference numbers held by Medicare and the insurer, if known.
• Identify the injured person, including their Medicare card number and contact details.
• Record the date of the injury or illness, a brief description, and the type of compensation, such as workers' compensation, motor vehicle accident, common law, or public liability.
• Provide the judgment or settlement date and amount, and the advance payment details if one is being made.
• Attach the Section 23A statement (MO023) if it applies, then complete, sign, and date the declaration. Incomplete forms are not processed.

How to submit Form MO022

Return the completed form and supporting documents by email to the Medicare Compensation Recovery address printed on the form, or by post to Services Australia, Medicare Compensation Recovery, at the postal address the form lists. Check every required question is answered before sending, because incomplete forms are not processed and changes to previously submitted forms are not accepted.
