A limited power of attorney, sometimes called a special power of attorney, authorizes an agent to act for the principal only for the specific tasks or time period written into the document. Instead of handing over broad control, the principal describes exactly what the agent may do, such as signing documents at a single real estate closing, managing one bank account, or handling a tax filing, and the authority ends when the task is complete or the stated date passes.

What is a limited power of attorney

A limited power of attorney is the narrow version of the power of attorney family. The principal grants authority for particular acts, in particular subject areas, and nothing more. The template pairs a checkbox for each category, such as banking, real property, or tax matters, with a blank line where the principal describes the exact transaction or task, and adds an explicit statement that the agent has no authority beyond what is described.

The document also builds in its own expiration. It ends on a stated date, on completion of the described acts, on written revocation, or on the principal's incapacity or death, whichever comes first. Like a general power of attorney, the limited form is non-durable, so it terminates automatically if the principal becomes incapacitated.

Limited vs general vs durable power of attorney

The three forms trade off scope and staying power. A general power of attorney grants broad authority across financial and legal matters but ends at the principal's incapacity. A durable power of attorney grants similarly broad authority and expressly continues through incapacity, making it the incapacity-planning document. The limited form is different on the scope axis: whether it lasts a week or a year, the agent can only ever do the specific things the document describes.

Use the limited form whenever a narrower grant will do the job. If you need someone to sign for you at a closing while you are out of the country, authorize that closing, not your whole financial life. Institutions on the receiving end also tend to accept a tightly described grant more readily, because it is obvious that the presented transaction falls within it.

What to include in a limited power of attorney

Precision is the whole point of this document, so the description of authority deserves the most attention.

  • Full legal names and addresses of the principal and the agent
  • The checked subject areas and a specific description of each authorized act, including account numbers, property addresses, or matter references where relevant
  • An effective date and a termination date, plus automatic termination on completion of the task, revocation, incapacity, or death
  • Express limitations, such as no gifts, no beneficiary changes, and no delegation unless specifically described
  • Compensation and reimbursement terms and a third-party reliance clause
  • Signature blocks for the principal, the agent's acceptance, two witnesses, and a notary acknowledgment

How to fill out the limited power of attorney template

Other common mistakes include forgetting a termination date and leaving the authority open-ended, expecting the document to work after the principal becomes incapacitated (it will not, since it is non-durable), and failing to send written revocation to the third parties involved if plans change before the task is done.
