What is a durable power of attorney
A durable power of attorney is a grant of authority from a principal to an agent that expressly survives the principal's later incapacity. Without durability language, an ordinary power of attorney ends the moment the principal loses the ability to make decisions. The durable form states the opposite: incapacity does not revoke or limit the agent's authority, so the agent can keep managing the principal's finances through illness, injury, or cognitive decline.
